Another manufacturer blocks drug for execution use

(AP) ? The manufacturer of the anesthetic blamed for Michael Jackson's death said Thursday it won't sell the drug for use in executions, a setback for Missouri and other states looking for an alternative after other drug makers also objected to their products' use in lethal injections.

Drug maker Fresenius Kabi USA, a German company with U.S. offices based in Schaumburg, Ill., says it is the only remaining domestic supplier of propofol. Earlier this year, Missouri adopted a new single-drug execution method that would make it the first state to use propofol as an execution drug.

Fresenius Kabi spokesman Matt Kuhn confirmed to The Associated Press that the company told its distributors in late August that such usage contradicts the drug's medical purpose and is "inconsistent" with the company's mission. It's also forbidden under European Union laws to export drugs that could be used in executions.

"Fresenius Kabi objects to the use of its products in any manner that is not in full accordance with the medical indications for which they have been approved by health authorities," a company statement reads. "Consequently, the company does not accept orders for propofol from any departments of correction in the United States. Nor will it do so."

Most of the 33 states with the death penalty had long used sodium thiopental as the first of a three-drug combination administered during lethal injections. But sodium thiopental became unavailable when its European supplier acknowledged pressure from death penalty opponents and stopped selling it for executions.

Supplies mostly ran out or expired, forcing states to consider alternatives. Most states have retained the three-drug method but turned to pentobarbital, a barbiturate used to treat anxiety and convulsive disorders such as epilepsy, as a replacement for sodium thiopental. But pentobarbital supplies also have shrunk after its manufacturer said it would try to prevent its use in executions.

Officials with the Missouri Attorney General's office and Department of Corrections didn't immediately respond Thursday to requests seeking comment about the propofol maker's stance. In August, the state Supreme Court declined Attorney General Chris Koster's request to set execution dates for six death-row inmates, calling it "premature" pending the uncertainty over propofol's availability.

Special Relevance Defeats FRE Prior Bad Acts Challenge - Criminal ...

A cocaine trial and a botched murder culminated in the rejection of the defendant?s appeal this week, in the First Circuit Court of Appeals.

The underlying case involved?a conspiracy to distribute cocaine. While the trial was pending, a federal witness was stabbed several times. The witness survived and his assailant received a 360-month sentence, which he appealed.

On appeal, he claimed that the District Court shouldn't have allowed certain documents and testimony at the trial. He also claimed that the statements made by the prosecution in the closing arguments prejudiced his case.

The evidence consisted of several letters from the defendant to a friend, where the defendant seemed to be?eliciting false testimony.

Also included as evidence was a statement, of which the court took judicial notice. The statement was stipulated by both parties and discussed a prior case where the defendant had been involved in an attempted murder. This statement also made mention of a witness in the prior case who subsequently recanted her testimony.

The defendant raised the "prior bad acts" evidentiary prohibition relating to the documents admitted at trial. However, the appellate court raised the "special relevance" argument, stating that the documents served a greater purpose than showing "mere propensity to behave a certain way."

As for the issue of prejudice, the court rejected that argument. The First Circuit Court of Appeals stated that the potential prejudicial effect of the evidence was mitigated by the cautionary instructions given by the trial judge, which addressed the jury's ability to weigh the evidence.

The judge also took care to prevent the government from narrowing in on the reason behind the former witness' recanted testimony.

The lesson here: While law school may have taught us that prior bad acts are inadmissible, the rule is far more complex. Be wary of the special relevance rules and the method in which the evidence is received by the court.

It seems that French No. 1 Hugo Lloris will be in Tottenham goal today in a Capital One Cup match against third-tier Carlisle United.

I know what Spurs manager Andre Villas-Boas says about his goalkeeping situation, that former U.S. international Brad Friedel is his man until further notice.

But we know how these things work. Pressure builds to get the $19 million transfer on the field. Lloris is already making noise. Voices from beyond are lending their support and saying that Lloris will soon be top man in goal at White Hart Lane.

Lloris is already Tottenham?s man for Europa League play; He?ll work the gloves today at Brunton Park (capacity 17,000). Villas-Boas says there will be several lineup changes from the weekend?s EPL result over Queens Park Rangers when Spurs meet the third-tier English side today.

Plus, I see Spurs fans beginning to pick nits in Friedel?s game. He?s not the distributor that Lloris is. His shot-stopping is fine, as always, but does he do enough to command the area and claim the balls that Lloris would presumably go gobble up?

Check out the comments here and you?ll see what I mean. No, lineup selections aren?t made by blogging comments. But public opinion and punditry often fuse to form a powerful force. So the first little wobble (and there will always be a wobble here and there, even for the very best player the world has ever seen) becomes the opening to acquiesce, if only to vent some pressure.

Prediction: Friedel will be a Spurs backup by the middle of October.

Not saying it should happen ? just saying that this Hugo Lloris thing is an unstoppable force that it will happen sooner rather than later.

Barnes & Noble's Nook HD 7-inch Android tablet, hands-on (video)

It was roughly this time last year that Amazon's Kindle Fire showed us just how successful an aggressively priced 7-inch tablet could be, becoming, arguably the go-to gift of the last holiday season. This summer, Google upped the ante, showing the world that a $200 tablet could be more than just an OEM-ed content delivery device, enlisting ASUS to design a really solid piece of hardware at a seemingly impossible price.

Barnes & Noble's journey in the space, meanwhile, has been decidedly more convoluted. In mid-October of 2010, the company gave the world the Nook Color -- a product with a wildly original industrial design, but decidedly limited functionality, which was, for most intents and purposes, an LCD-based color e-reader. Halfway through the following year, the device got a Pinocchio-like upgrade, transforming it into an honest-to-goodness tablet, apps and all. The device's celebration was cut short, however, eclipsed entirely by the arrival of the aesthetically (nearly) identical, but internally superior Nook Tablet.

When Amazon announced the release of the Kindle Fire HD and all of its many variants, there was little question that Barnes & Noble had something waiting in the wings as well. After all, much of the bookseller's hardware game plan seems to revolve around going toe-to-toe against Amazon offerings, and since the company beat its chief competition to the market with a glowing reader, a Nook Tablet seemed all but inevitable. With this week's announcements, however, the company has managed to offer up some surprises -- for starters, there's the fact that it's doubled its efforts with the release of two tablets -- with the 7-inch Nook HD and the 9-inch Nook HD+. Then there's the fact that the company has clearly put great effort into the hardware this go-round, rather than offering up yet another rehash of the Color / Tablet lineage. Scolari says he plans to coach again in 2013

SAO PAULO (AP) -Brazilian World Cup-winning coach Luiz Felipe Scolari says he is likely to start managing again in 2013.

He says he expects to "get a coaching job again next year," although without elaborating whether it will be with a club or a national team. The 63-year-old Scolari has said in the past that he wants to manage a national team at the 2014 World Cup in Brazil.

Scolari, who led Brazil to the 2002 World Cup title, and eight-time national champion Palmeiras mutually ended their contract two weeks ago because the coach had failed to get the team out of relegation zone.

Scolari's comments Tuesday came as Brazil's sports ministry announced he will work as a consultant, giving speeches to young Brazilians about his sports experience and promoting the World Cup.

    2013-2014 City Budget: Listening Closely and Investing Wisely

    2013 budget logoThis afternoon, the Mayor will propose to the City Council how he believes we should spend the nearly $1 billion in our city?s general fund budget. He makes his presentation at 2 p.m. in City Hall. You can attend and be part of the audience or watch it on the Seattle Channel.

    As chair of the Council?s Budget Committee, here?s how I will evaluate the Mayor?s proposal:

    • Does the budget focus on your priorities and the basic services city government is obligated to provide? Are we getting our core work done on your behalf?
    • Does the budget fund programs that work and achieve the desired results? Are we spending wisely and effectively?
    • Does the budget reflect our shared values for fairness, opportunity for all, justice and protecting the most vulnerable?
    • Does the budget advance our quality of life? Among all the choices we face, are we strategically focused on spending that will do the most good?

    Listening to You

    When deciding how to spend your tax dollars the most important thing we can do is listen. My staff and I have been attending community meetings and listening to residents throughout our city.? Most folks are busy with their jobs and families and have not yet been able to voice their views.     Funding Only What Works

    Earlier this year the budget forecast for next year was looking pretty gloomy, but the Mayor?s Budget Office recently signaled there would be money for new investments.? Before we rush to launch new programs or expand current ones, however, I believe we must see clear and independent evidence that our investment will produce the desired outcomes.

    Last week, the Council passed Resolution 31404, legislation I introduced that will frame our budget analysis by asking the following questions about new investments:

    1. What are the long-term and measurable goals (outcomes) of the proposed program?
    2. What is the gap between the current situation (status quo) and the goals?
    3. How effective will the program be in making progress toward the goals?
    4. How will the program?s progress be measured to prove whether it achieved results?

    Public safety is an important example. Earlier this month our City Auditor and the Center for Evidence-Based Crime Policy at George Mason University published a report that verifies what we discovered last year:? we are spending millions of dollars on over 60 crime prevention programs, but we can only be sure a handful work well. The Mayor?s budget must begin to address this gap between research and practice. It should set up independent evaluations to confirm whether programs achieve their goals, stop funding programs that do not work, and increase funding only for programs that do.

    We should be funding programs with clear and independent evidence of success. And we should stop funding programs that don?t work so we can free up money for the successful programs.

    Here?s a strong example:?Nurse Family Partnership (NFP).

    I pushed to increase funding for this program last year and my committee received an update on its progress two weeks ago. NFP is a program that sends specially-trained nurses into the homes of first-time moms living in poverty. The nurses help the mom early in her pregnancy and continue to visit until their child reaches age two.? The program has been operating for more than 30 years and it is one of the most tested and most successful programs in the country.

    The results of NFP are clearly documented?a decreased likelihood of criminal involvement by both the mother and child, better academic outcomes for the child, stronger economic stability for the mother and lower government costs. Independent reports rank NFP as among the most effective and most efficient interventions possible to improve child welfare and prevent crime. Yet, our current funding of the NFP is not enough to reach all the eligible moms in Seattle. We can and should expand this program.

    As the Council?s budget process kicks into gear, my colleagues and I will listen to you and ask the hard questions about new spending.? After all, it?s your money. Together, let?s make sure we invest in what works.

    Attackers blow up gas and oil pipelines in Yemen

    (AP) ? An explosion struck a gas pipeline Tuesday in southern Yemen, temporarily halting the flow of gas although exports were not affected, a government official said.

    An oil ministry official said the Liquefied Natural Gas Co. pipeline was sabotaged but did not specify by whom. He said repair work was under way.

    The official spoke on condition of anonymity because he was not authorized to speak to reporters.

    The bombing in Yemen's Shabwa province comes on the heels of a late Monday attack on an oil pipeline nearby, which security officials said halted the flow of 8,000 barrels pumped there.

    Government oil officials estimate the repeated pipeline attacks have cost the country $2.5 billion, and previously have blamed al-Qaida for the damage.

    A statement by the gas company said nobody was hurt in Tuesday's explosion. Yemen LNG Co. was created in 1995 ? the country's first natural gas liquefaction consortium. Its major shareholders include French oil company Total SA and Dallas-based Hunt Oil Co. It also is backed with Asian, U.S. and Yemeni government funding.

    LNG provides a tiny percentage of the abundant natural gas supplies in the U.S.

    The ASU community had mixed reactions to federal judge Susan Bolton?s ruling last week that lifted the injunction on the ?papers, please? provision of Arizona?s immigration law, Senate Bill 1070.

    The provision, which is now in effect, requires officers to question the immigration status of anyone they suspect is not lawfully present in the country.

    Chicana-Latina issues professor Sujey Vega said this decision affects ASU deeply and cannot be separated from President Barack Obama?s new immigration policy.

    The policy, commonly called ?mini-DREAM Act,? allows young illegal immigrants to apply for two-year deportation waivers as long as they have no criminal records, are students or have served in the military.

    Despite the president?s new policy, Vega said Arizona?s immigration law has made undocumented students less likely to come forward.

    She said she admires and supports the DREAMers who have joined the ?undocumented and unafraid? movement.

    ?I give them a lot of credit, especially in an environment like Arizona,? she said.

    This is not only a Latino issue, Vega said.

    ?I fear it makes us look bad as a state, and I fear the University is impacted by it,? she said. ?Because of (SB) 1070, speakers refuse to come to ASU (and) international students think twice about enrolling. It affects all of us.?

    The law targets a particular racial group regardless of whether they are actually illegal immigrants, Vega said.

    ?It?s a hazard for those of us who look ?foreign,?? she said. ?We know there?s a specific look they?re searching for. If the law was followed, then everybody would be checked.?

    Vega said the law segregates the community.

    ?As a society, we need to learn how to work together,? she said. ?This law only divides us.?

    Joe Garcia, director of Latino Public Policy at the Morrison Institute for Public Policy, said SB 1070 is not enforceable.

    ?The underline of the ?Show Me Your Papers? provision is that even if you arrest someone, there?s no way to get them processed,? he said.

    SB 1070 cannot be separated from the DREAM Act, Garcia said.

    ?Regarding ASU, you can?t talk about SB 1070 without talking about the DREAM Act,? he said. ?The second will trump the first one, for sure.?

    The immigration law has a psychological effect on people, Garcia said.

    ?It affects undocumented people who don?t know all the facts,? he said. ?SB 1070 isn?t quite the legal monster we thought it would be.?

    Teaching English to speakers of other languages graduate student Linda Hill said she does not consider SB 1070 discriminatory.

    ?People carrying papers to show their legal status is not racial profiling,? she said. ?There are internationals in my family who have gone through the process to become documented.?

    Hill said she supports legal immigration.

    ?We?re a nation of immigrants and we welcome them as long as they go it the right way,? she said.

    Biochemistry junior Esequiel Olivares, the son of immigrants, said SB 1070 racially profiles people.

    ?It?s unfair for the little kids whose parents brought them here,? he said. ?It should be enforced, but in a different manner.?

    The law has impacted the Hispanic community, Olivares said.

    ?A lot of people have moved,? he said. ?I grew up in a Hispanic community and most of them have left.?

    Turkey clips military's wings in landmark verdict


    ISTANBUL | Sun Sep 23, 2012 11:55am EDT

    ISTANBUL (Reuters) - The jailing of hundreds of Turkish army officers including top generals accused of plotting to topple Prime Minister Tayyip Erdogan underscored how far he has come in gaining control of the country's once all-powerful military.

    But Erdogan, 10 years in power, must grapple with suspicions among critics and even some sympathizers that he is using this and other coup investigations to silence opposition as he sets about taming a militant secularist establishment. Far from flinching, he may seek more power in a revamped presidency.

    The verdict against 325 officers at the end of the 21-month trial on Friday would have been unthinkable a decade ago, when generals regularly intervened in policy-making as self-appointed guardians of Turkish secularism.

    Judges in the case, dubbed Sledgehammer, handed down prison sentences ranging from six to 20 years against the officers for plotting to wreck Erdogan's rule almost 10 years ago, soon after his Islamist-rooted party swept to power with the biggest share of the vote in decades.

    Hilmi Ozkok, who was head of the armed forces at the time, rejected accusations the court's decision was driven by revenge.

    "The ruling will serve as a deterrent and has a lesson for everyone ... in understanding how much Turkey and the rest of the world has changed," Ozkok told Milliyet newspaper on Sunday.

    Turks reading such words from the mouth of the former armed forces chief will gain a measure of the scale of change since Erdogan's AK party was first elected in 2002. The generals then made no secret of their disdain for a man who had served a brief prison sentence for religious incitement and had backed a short-lived Islamist government they eased from power in 1997

    When AK was elected for a second term in 2007 with an even larger margin of victory, an emboldened Erdogan launched a series of investigations into officers, lawyers, politicians, journalists and others that exposed several alleged conspiracies against the government.

    The plots consisted of plans to foment unrest and pave the way for an army takeover. Sledgehammer, a war game scenario played out at a barracks in Istanbul in March 2003, included plans to bomb historic mosques in Istanbul and trigger conflict with Greece.

    For many, it was all too easy to believe. Turkey's military, NATO's second biggest, staged three outright coups between 1960 and 1980 and pressured a fourth government, the first Islamist-led, from power in 1997.

    ENDING 'MILITARY TUTELAGE'

    Under Erdogan, a devout Muslim, curbs on religion have been relaxed. Women are allowed to more freely wear the Islamic headscarf, alcohol is heavily taxed, and students at religious high schools are able to more easily attend university.

    Journalists complain of pressure to write favorable stories about the government, and a number of writers are among those arrested under another plot investigation, "Ergenekon".

    "This (Sledgehammer) case is an important step towards ending the army's political role but it's not enough to stop it completely," said Sahin Alpay, professor of political science at Bahcesehir University and a columnist for Zaman, seen as close to the government.

    "Now we need a new constitution and laws that place the army under civilian supervision and reform military schools to reflect the values of a liberal democracy," he said.

    A new constitution is now under consideration to replace a restrictive code inherited from the military after a 1980 coup. Turkey may well emerge from the debate with a presidential republic and a powerful president in Erdogan.

    Alpay acknowledged there were questions about the case with so many defendants on trial at once, the judges' refusal to allow in some defense evidence and the lengthy sentences.

    A key issue at appeal is likely to be the defense's inability to submit legal expert testimony that computer documents submitted as evidence appeared fake.

    Defense lawyers said they would appeal the verdict this week to Turkey's upper court and, if necessary, eventually apply to the European Court of Human Rights.

    RINGLEADERS

    Generals Cetin Dogan and Halil Ibrahim Firtina and retired admiral Ozden Ornek, who were considered Sledgehammer's ringleaders were given life terms, reduced to 20 years because the coup plot had failed.

    Critics of the government have said the trial was a purge of the government's opponents in the army's ranks.

    "This isn't really a legal case," said Pinar Dogan, Cetin Dogan's daughter and a lecturer at Harvard University. "It's a wider operation with powerful forces behind it ... and we see those with firm secularist beliefs are the ones targeted."

    She said her mother Nilgul Dogan, 60, faces three years in prison in a separate case for planting a rose bush near the courthouse to protest against the trial.

    Others said the case failed to go far enough.

    Gultan Kisanak, co-chairwoman of parliament's pro-Kurdish Peace and Democracy Party, said the indictment did not include crimes she says were committed in a 28-year long war with the Kurdistan Workers Party (PKK) that has killed more than 40,000 people.

    "Military tutelage, a tradition of coups, contra-guerrilla activities, extrajudicial killings and other dark events are all part of our recent political history," she said.

    "While we need a process to confront and reconcile our past, the government instead opted to settle its own scores."

    Sledgehammer is one of a series of trials that has raised questions about whether the government is using the courts to silence political opponents.

    Others include the "Ergenekon" case, which involves a web of alleged plots against Turkey's government, and the "KCK" trials which accuse thousands of Kurdish journalists, academics, lawyers and others of belonging to the PKK, viewed as a terrorist group by the United States and Europe for its campaign of violence for greater autonomy in southeastern Turkey.

    The court ruling also has the potential to undermine morale in the military as it battles the PKK in the heaviest fighting in more than a decade and faces a growing challenge maintaining security along its southern border with war-torn Syria.

    A hundred or so people gathered near Taksim Square in central Istanbul to protest the verdict.

    "This case was an effort to silence those who defend the secular republic," said Hanife Kopuz, 55, clutching a cloth banner of Mustafa Kemal Ataturk, who founded the modern Turkish republic from the ruins of the Ottoman Empire.

    "This may be a turning point, reducing support for the government. They can't stay in power forever but I fear what they will leave in their wake," she said.

    Rep: Green Day's Armstrong getting treatment

    NEW YORK (AP) ? Green Day's Billie Joe Armstrong is headed to treatment for substance abuse.

    Sunday's announcement by the band's rep comes after the 40-year-old frontman had a meltdown onstage at the iHeartRadio Music Festival in Las Vegas on Friday. As Green Day was wrapping up its performance during the all-star, two-day concert, Armstrong profanely complained that the band's time was being cut short.

    "One minute left, one minute (expletive) left. You're gonna give me (expletive) one minute? ... I'm not (expletive) Justin Bieber, you (expletives)!" he yelled (although Bieber was not part of the night's festivities).

    Armstrong smashed his guitar before leaving the stage.

    In a statement to The Associated Press, Green Day apologized "to those they offended at the iHeartRadio Festival" and said its set was not cut short by Clear Channel, the host of the two-day festival.

    The Grammy winning band also is canceling some of its promotional appearances. It is due to release the album "Uno" on Tuesday, the follow-up to "21st Century Breakdown," released three years ago. "Uno" is the first in a trilogy of albums; the second is to be out in November, and the last in January. The band is due to kick off a nationwide tour Nov. 26 in Seattle.

    Armstrong was hospitalized in early September in Bologna, Italy, for an undisclosed ailment, but recovered well enough to perform at the MTV Video Music Awards on Sept. 6. Since then, the band has made a series of performances, including a "Good Morning America" performance and a New York City concert for the launch of Nokia Music on Sept. 15. No interviews of the band were allowed that evening, but the band chatted with fans and Nokia and AT&T executives before performing for about two hours.

    It's unclear what Armstrong is receiving treatment for; in 2003, he was arrested for DUI, and has acknowledged in the past taking various drugs but has said he now eschews them.

    Green Day is one of rock's top acts and had huge success with its 2004 politically charged album "American Idiot," which went on to become a Broadway musical. Armstrong performed for a stretch in the musical.

    Most recently, he was a mentor on the NBC talent competition "The Voice."

    AUSTIN -- Austin is a growing city and inevitably there are growing pains.

    "It's a lot more expensive and it's a lot more crowded," said Phil Rugeley, who's been living in Austin since the 1970s.
